These Terms and Conditions ("Terms") govern your access to and use of the Qualma website, applications, services, content, and features (collectively, the "Service").

The Service is owned and operated by MazeWorks SLU, Calle Francisco Campos 20, 28002 Madrid, Spain ("MazeWorks", "Qualma", "we", "us", or "our").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

1. Description of the Service

Qualma is a digital platform designed to help dog owners record, organize, and review information related to dog training activities, including activities associated with separation-related behaviors.

The Service may include:

• Dog profiles
• Training logs
• Progress tracking
• Educational content
• Analytics and reporting features
• AI-powered analysis features
• Subscription services
• Other features introduced from time to time

The Service is intended solely for informational, educational, organizational, and record-keeping purposes.

2. Important Disclaimers

2.1 Not Veterinary Advice

Qualma is not a veterinary service. Nothing provided through the Service constitutes veterinary advice, diagnosis, treatment, medical guidance, or professional consultation. Users should always seek advice from qualified veterinarians, veterinary behaviorists, trainers, or other appropriate professionals regarding their dogs.

2.2 Not a Medical Device

The Service is not a medical device, veterinary device, healthcare product, diagnostic system, treatment platform, or regulated healthcare service.

2.3 No Diagnosis

Qualma does not diagnose separation anxiety, behavioral disorders, medical conditions, psychological conditions, or veterinary conditions. Any information provided through the Service is educational only.

2.4 AI Limitations

Any AI-generated content is automatically generated based on information provided by users. AI-generated content may be incorrect, incomplete, outdated, inaccurate, misleading, or unsuitable for a particular dog or situation. Users remain solely responsible for evaluating any information generated by the Service.

3. Eligibility

You must be at least eighteen (18) years old to use the Service.

By creating an account, you represent and warrant that:

• You are at least 18 years old;
• You have legal capacity to enter into these Terms;
• The information you provide is accurate and complete.

We may suspend or terminate accounts that violate this requirement.

4. Account Registration

To access certain features, you may be required to create an account.

You may register using:

• Email authentication
• Google authentication
• Other authentication methods offered by the Service

You are responsible for:

• Maintaining account security;
• Keeping login credentials confidential;
• Activities occurring under your account.

You must immediately notify us of any unauthorized use of your account.

5. User Content

Users may submit information including:

• Dog photos
• Training records
• Notes
• Progress information
• Speech-to-text generated notes
• Other content

You retain ownership of your content. However, by using the Service, you grant MazeWorks a worldwide, non-exclusive, royalty-free license to process, store, display, analyze, and use such content solely for operating, maintaining, improving, and providing the Service.

6. Anonymized Data

You acknowledge and agree that MazeWorks may create anonymized datasets derived from information submitted through the Service.

Anonymized data:

• Does not identify individual users;
• Cannot reasonably be linked back to individual users;
• May be retained indefinitely;
• May be used for analytics, research, service improvement, product development, and AI-related improvements.

No ownership rights are granted to users in anonymized datasets.

7. Acceptable Use

You agree not to:

• Violate any applicable law;
• Submit unlawful content;
• Upload malicious software;
• Interfere with Service operations;
• Attempt unauthorized access;
• Reverse engineer the Service;
• Abuse AI features;
• Use automated scraping tools without permission;
• Impersonate another person or entity.

We reserve the right to investigate suspected violations.

8. Subscriptions and Payments

Certain features may require payment.

Payments may be processed through third-party payment providers including Stripe.

Pricing, plans, and features may change at any time.

We reserve the right to:

• Introduce paid features;
• Modify subscription plans;
• Change pricing;
• Discontinue plans.

Where required by law, reasonable notice will be provided before pricing changes take effect.

9. Cancellation

Users may cancel subscriptions at any time through available account settings or payment providers.

Cancellation prevents future renewals but does not automatically create a refund entitlement unless required by applicable law.

10. Account Deletion

Users may request deletion of their accounts through the Service or by contacting MazeWorks.

Upon deletion:

• Email addresses will be deleted;
• User names will be deleted;
• Authentication identifiers will be deleted;
• Dog photos will be deleted;
• Personal identifiers will be removed;

Training records and related data may be retained only in anonymized form where such data can no longer be associated with an identifiable individual.

11. Intellectual Property

The Service, including:

• Software
• Design
• Logos
• Trademarks
• Content
• Databases
• Features

are owned by MazeWorks or its licensors. No rights are granted except those expressly stated in these Terms.

Users may not copy, modify, distribute, sell, license, or reverse engineer any part of the Service without written permission.

12. Service Availability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

MazeWorks does not guarantee:

• Continuous availability;
• Error-free operation;
• Data accuracy;
• AI accuracy;
• Uninterrupted access;
• Compatibility with all devices.

Temporary interruptions may occur due to:

• Maintenance;
• Upgrades;
• Security incidents;
• Third-party failures;
• Events beyond our control.

13. Right to Suspend or Terminate

MazeWorks may, at its sole discretion, suspend accounts, restrict access, refuse service, remove content, or terminate accounts with or without notice where reasonably necessary.

Reasons may include:

• Violations of these Terms;
• Abuse of the Service;
• Fraud;
• Security concerns;
• Legal requirements;
• Protection of other users;
• Protection of MazeWorks.

14. Changes to the Service

We reserve the right to:

• Add features;
• Remove features;
• Modify functionality;
• Change pricing;
• Change technologies;
• Discontinue any portion of the Service;
• Shut down the Service entirely.

Nothing in these Terms guarantees the continued availability of any feature.

15. Limitation of Liability

To the maximum extent permitted by law, MazeWorks shall not be liable for:

• Training outcomes;
• Behavioral outcomes;
• Veterinary outcomes;
• Property damage;
• Injury to animals;
• Injury to persons;
• Emotional distress;
• Business losses;
• Loss of profits;
• Loss of goodwill;
• Indirect damages;
• Consequential damages;
• Special damages;
• Punitive damages.

Users remain solely responsible for decisions made regarding their dogs and training activities.

16. Maximum Liability

To the maximum extent permitted by law, MazeWorks' total liability arising out of or related to the Service shall not exceed:

(a) the amount paid by the user to MazeWorks during the twelve (12) months preceding the event giving rise to the claim; or

(b) one hundred euros (€100),

whichever amount is greater.

17. Indemnification

You agree to defend, indemnify, and hold harmless MazeWorks and its directors, employees, contractors, affiliates, and partners from claims, liabilities, damages, losses, costs, and expenses arising from:

• Your use of the Service;
• Your violation of these Terms;
• Your content;
• Your actions relating to your dog.

18. Privacy

Use of the Service is also governed by the Qualma Privacy Policy, which forms part of these Terms.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain.

20. Disputes

Any dispute arising from or relating to these Terms or the Service shall be submitted to the competent courts of Madrid, Spain, unless mandatory consumer protection laws require otherwise.
